Occupational Health & Safety legislative framework

In Australia there is fairly strong, yet not totally consistent Occupational Health & Safety legislative framework in place across both federal and state/territory jurisdictions.

The majority of the states/territories have adopted the model national uniform legislation using Work Health and Safety (WHS) terminology, whilst both Victoria and Western Australia persist with their legacy legislation using Occupational Health and Safety (OHS) (or Occupational Safety and Health (OSH)).

No matter which jurisdiction you’re in, our health and safety specialists have expertise across a diverse range of industries, including mining, government, construction, heavy and advanced manufacturing to name a few.

Workplace Health and Safety (WHS) Management System

State or territory legislation requires the person conducting a business or undertaking (PCBU) to provide safe systems of work. A Workplace Health and Safety (WHS) Management System is thus an essential aspect of the business to ensure the health and safety of every person the business interacts with, internally and externally. Previously in Australia, Health and Safety Management Systems were based on AS/NZS 4801:2001 and AS/NZS 4804:2001. However, since 2018 ISO 45001 has now replaced both 4801 and 4804.

Our hands-on approach helps us foster long-lasting relationships with our clients where we can help them achieve their health and safety targets. We can do this by providing technical advice and independent expert review capabilities.

Why do we need a WHS Management System?

A WHS management system is any system that helps a business create and maintain a safe work environment. Within that, the system must also:

Minimising and avoiding workplace injuries;
Providing for continual evaluation and improvement; and
Ensuring compliance.

Safety Plans and Procedures

Safety plans outline specific health and safety procedures for different environments and work areas. These plans can ensure that all workers are able to understand their obligations.

Policies and procedures establish an overarching framework for following safety plans. Usually, each organisation must devise their own system, however some companies offer “off the shelf” products. The policies may include a commitment to health and safety, return to work, etc. Procedures include hazard identification and incident reporting.

Training may include a vast array of areas relating to skills in the workplace. The need to ensure everyone can conduct their tasks safely at a workplace is required for everyone whether they be a worker, contractor, volunteer, visitor or duty holder. This requires each person to understand their obligations and duties to the company, the work site and to each other under the WHS Act.

Safety Plans and Procedures

Monitoring includes hazard identification and risk assessment. This typically occurs before the work begins, however may also be undertaken during tasks if circumstances change, for instance using a Take-5. Supervision must also occur to ensure the performance of tasks are undertaken safely within the workplace.

Reporting is the final element. Safety reporting occurs at every level of an organisation. Workers and managers need to report and rectify unsafe hazards and conditions whilst board members also have an obligation to remain aware of safety issues being experienced by the workforce.
